The Democratic Party of Kosovo sues ERO

The Democratic Party of Kosovo has sued ERO at the Basic Court in Pristina for their decision to liberalize the electricity market.
This decision, according to PDK, was made in the absence of a fair, legally based and comprehensive process, and has already begun to produce serious and irreversible consequences for over 1,300 local businesses and over 140 thousand employees of these enterprises.

The Democratic Party of Kosovo, remaining loyal to its responsibility to protect the public interest and the rights of the country’s citizens and businesses, has today submitted a lawsuit to the Basic Court in Pristina to annul the decision to liberalize the electricity market in Kosovo.
This decision, taken in the absence of a fair, legally based and inclusive process, has already begun to produce serious and irreversible consequences for over 1,300 local businesses and over 140 thousand employees of these enterprises. The effects of this decision are seriously jeopardizing the economic stability of the country by increasing prices, fueling inflation and threatening the bankruptcy of a large number of businesses.
In addition to the main lawsuit, PDK has also requested from the court the imposition of a security measure – the immediate suspension of the implementation of this decision – in accordance with Article 100 of Law No. 08/L-182 on Administrative Conflicts, to prevent the damages that are being caused every day.
In this process, PDK has acted as a plaintiff with full legal legitimacy, in defense of the collective interest of the citizens and businesses of Kosovo. The decision-making of the Energy Regulatory Office has violated not only the legal rights of consumers whose turnover exceeds 10 million euros per year or who employ over 50 people, but has also directly affected the economic interest of all citizens of the Republic of Kosovo.
The preliminary procedure followed at ERO has fully confirmed our long-standing concern: this institution has not issued any final administrative decision on market liberalization, but has used a simple notification to impose a heavy obligation on the private sector. This action was done deliberately, with the aim of avoiding judicial control.
In accordance with the principles of the rule of law and based on concrete arguments and evidence, PDK has taken all necessary legal steps to initiate this judicial battle, in the interest of the public and the law.
We expect the court to objectively assess our request for the imposition of a security measure and to suspend the implementation of this decision until a final decision is made on its legality.
At the same time, we welcome today’s decision of the Commercial Court, which approved the request of a private company to suspend this decision. This decision constitutes an important precedent and we hope that it will be confirmed in all judicial instances, serving as a basis for the unification of judicial practice in similar cases.
