Data Center, the 4 new features:

  1. No longer “derogation from urban planning rules and instruments, but “simplification of urban planning regulations”.
  2. Existing data centers are no longer excluded from the scope of the law. Initially, they were cut off. Madness.
  3. Therefore, if a benefit were to be established in the implementing decrees, this must also be in favor of existing data centers, i.e. those who have already invested in Italy to build data centers.
  4. A form correction has been carried out on the ATECO code. Previously it was exclusive for “construction and indirect enhancement”, now it is explicit that it also concerns “expansion or management”.

Risks averted

With this new version, the text of the law delegating to the Government now seems really improved and ready to achieve its initial goal: “finally offer”, as the Honorable Pastorella had explained to us, “a concrete response to the numerous local administrators who, in the absence of clear and uniform authorization processes, have found themselves in serious difficulty in managing requests for the establishment of data centers in their territories. Many mayors and councilors have turned to the Legislator for a certain regulatory reference, and I hope that this law will be approved soon to guarantee them a clear and coherent regulatory framework”.

Both the derogation from the regulations and the exclusion of the current data centers were two senseless and harmful regulations, at least they have been corrected (can you imagine someone who places a data center next to a river because it derogates from any regulation, at the first rain everything floods and the internet of half of Italy turns off =D)
