A few days ago they asked about conflicts when it came to putting the order of children’s surnames. Here my opinion of what would be ideal:

We have had a system for centuries that, without being perfect, seems to me to be far better in terms of simplicity and documentary practicality than in most countries in the world.

The downside was that the mother’s last name ended up disappearing. They wanted it to be equal, but something that was good, they have ruined it downwards when it could have been equalized upwards. As?

  1. In the same way that we have a direct paternal surname (in the photo, surname A), we can do the same with a direct maternal surname (surname M)

  2. We continue with the same system, but now the mother gives her maternal instead of paternal. Thus, in the long run, a direct matrilineal surname is created symmetrical to that of the father.

  3. The children still have two surnames, but the brother takes his father’s name and the sister takes his mother’s name.

  4. What order?

A) maintain the current order, the second would now be an authentic maternal surname. The documentary aesthetic continues.

B) let it be the maternal surname first. There are several reasons for this: children tend to be with the mother when there are divorces and when having children with a second person, it is more aesthetic and appropriate than the first surname they share, which is the one usually used, being that of the mother. Hermans of different fathers, when presented with a surname, sound with the same one.

C) flexible and free order and unrelated to inheritance. The parents choose the order (it does not affect the inheritance of the surname, the father gives his paternal name and the mother gives her maternal name as well).

  1. Exceptions:
    A) allow the merger of two surnames if at least one of them is going extinct and has some historical or personal value.

Pedro Garcƭa GonzƔlez has children with Maria Huidobro Alonso.

The children could be Garcihuidobro Alonso or GarcĆ­a Huidobralonso. Or GarcĆ­a Huidobro-Alonso/ GarcĆ­a-Huidobro Alonso.

B) family trauma (demonstrated or documented) and wants to cut that line and use that of another family member.

  1. Gays: the genetic father gives him his paternal last name and the other father gives him "maternal" (you have to see other options and nomenclature such as Surname A and B…). Exceptions (.5) also apply here.

  2. Lesbians: genetic mother maternal surname, mother "adoptive" the paternal (.5 exceptions also apply)

  3. Transgender couples: I would apply the sex criterion for more Y-chromosome and mitochondrial reasons than anything else. The gender criterion can also be applied instead of sex and point 5.

Summary:

  • Order unrelated to inheritance (can be fixed sex/gender on the left or right, or free and musical)

  • The first surname is no longer inherited but the "patronymic" of the father and the "matroconymic" of the mother

  • list of stipulated and admitted exceptions that give a little more flexibility and freedom when there is serious justification.

  2. Acaba de ascender a mí top 3 de cosas innecesarias que he leído hoy por Reddit. Pero eh, currazo, mis felicitaciones. Tiene lógica lo que dices. Es solo que me parece complicarnos tontamente.

  3. Yo siempre he pensado que es mejor elegir los apellidos menos reconocidos o interesantes, a mantener los mƔs habituales.
