DIVORCE HAS BECOME A CONFLICT

EC He is a 30-year-old young judge. He is on duty at Büyükçekmece Courthouse. He’s just like the minister of justice, from what he’s been through. “Türkiye is a state of law” he thought.

He got married last June 29. From the first days of their marriage, his wife D.K. They were having a disagreement with. In August, they went to E.K.’s hometown, Ordu, on annual leave. While EK was waiting for her husband, her husband’s brother came. He had a gun on his waist. He was angry at E.K., who was in the process of divorcing his brother. He talked a little first. Then he insulted me. He threatened. Later “They are waiting for you at home” He took her to his other sister’s house by car.

According to the statement given by Judge E.K., there were seven people in the house. His father-in-law, his wife’s brother, his brother-in-law, his brother-in-law’s father, his wife, his wife’s sister, his wife’s mother.

KICKING, SLAPING AND BEATING THE JUDGE

After being insulted for a while, he wanted to get up and leave. But it wasn’t that easy. Let me quote from his statement:

While I was trying to leave the room, my father-in-law grabbed my throat and slapped me hard in the face. At this point I fell to the ground. I couldn’t leave this house for about 1-2 hours. After the incident, I went to my uncle’s residence. My clothes were bloody. There was bleeding on my lip. I still have swelling on my head. After I regained my composure, I went to Bahçelievler State Hospital and got a report. “After the report, I went to the police station.”

The doctor’s report given at 16.31 that day showed signs of assault. On the other hand, judge EK recorded the events for 1 hour and 53 minutes by pressing the record button on the phone in his pocket from the beginning of the incident. He had it analyzed and added it to the file. From the recording, which also includes beating sounds, it is understood that the family attack was caused by Judge E.K’s failure to call his wife for two weeks after their argument and also how the wedding gold would be divided.

However, there was something he didn’t know…

His brother-in-law, who owned the house where he was detained, had good relations with the government. He was working as a corporate lawyer for one of the state-run organizations. He was working with a former AKP MP. He was currently an informal advisor to a sitting MP. He was working in a law association close to the government.

Naturally, it was not that easy to detain those people who beat judges. The file at the Bakırköy Public Prosecutor’s Office remained on the shelf for three and a half months.

On December 25, a “No prosecution” decision was issued against all seven people for various crimes, including forcible detention, due to “lack of evidence”. On the other hand, the incident was too big to be closed with this decision. There was a voice recording containing death threats and an assault report. The state judge also said, “I was beaten.” The owner of the house where Judge E.K was detained for insulting and simple injury against his wife’s brother and father “remembered” It was decided to continue the investigation against the brother-in-law for insult. The three names were released with a judicial control order.

I learned that once “Türkiye is a state of law” Judge EK said, and when he saw the power of politics over the judiciary, he no longer thought so. He saw the limits of the law when he moved from being a judge to seeking justice.
