Here’s when the constitutive session of the Kosovo Assembly will continue
Following President Vjosa Osmani’s letter, the time and date when the constitutive session for the ninth legislature of the Assembly will continue has now been announced.
The official website of the Parliament states that the constitutive session will continue on Thursday, from 12:00.
Osmani has returned the letter to Avni Dehari, the chairman of the Kosovo Assembly session, after the failure of yesterday’s session and the continuation of further steps. Osmani said that the deputies should gather within 24 hours, reports KosovaPress.
“The Constitution obliges you to implement and not block processes, gather within 48 hours,” the letter states.
Osmani cites the Constitutional Court Judgment in Case No. K072/20, which states that constitutional structures should be interpreted in a way that “enlivens and does not block” the functioning of the powers that emerged from the vote of the citizens.
The Court has clearly emphasized that no constitutional norm may be interpreted in such a way as to block the establishment and effective functioning of the legislative and executive branches of government.
The President also mentioned another Judgment of the Court in case No. K0119/14, which emphasized the obligation of all deputies to find ways to make the Assembly functional, as well as the responsibility of the chair of the constitutive session to fulfill duties in accordance with the Constitution and the Rules of Procedure of the Assembly.
Referring to these principles, Osmani emphasized that the judicial practice of the Constitutional Court now has a binding character, and that it is the responsibility of everyone to contribute to the functionalization of institutions that stem from civic will.
The session for the constitution of the ninth legislature was adjourned on Tuesday.
The chairman of the session, Avni Dehari, adjourned the session due to the failure to vote on the report on the confirmation of mandates. There were 52 deputies in favor, 46 against, and 11 deputies who abstained.
The Democratic Party of Kosovo, the Democratic League of Kosovo, and the Alliance for the Future of Kosovo voted against the temporary committee’s report. Meanwhile, deputies from the Vetëvendosje Movement and Nisma voted in favor of the report.
The leader of the Vetevendosje Movement, Albin Kurti, has called it “an attack on the institution and democratic elections.”
We remind you that after the constitution of the Assembly, the Government mandate holder from the first winning party, the Vetëvendosje Movement, has 15 days, as provided for by the Constitution, from the date of the mandate, to use the time to secure the necessary votes for the government, which must have at least 15 votes.
In the event of failure to form a government, it is up to the second party, PDK, to take the mandate to form the government.
