Arrest warrant sought for Rakic, suspected of being in Serbia

The placement of barricades in the four northern municipalities in 2022 is being investigated by the Kosovo Special Prosecution Office.
The organization of the deployment of this heavy machinery on the northern roads is suspected to have been done by the former leader of the Serbian List at the time, Goran Rakić, now a member of the Serbian Parliament.
According to the SPRK, Rakić is suspected of the criminal offenses: obstructing an official in the performance of official duties, calling for resistance, and joining in unconstitutional activities.
This prosecution has summoned Rakić three times for an interview regarding this investigative matter, but he has not appeared.
Therefore, he has filed a request with the Basic Court of Pristina for the issuance of an arrest warrant against him.
Arbnora Luta, communications officer at the Special Prosecution Office, says that current senior officials in the Serbian List have also been interviewed about this case.
“The interview of defendants SS, IS, and ZE has already been completed. As for the interview of GR, he was invited three times, but did not appear, initially justifying his absence with health problems, while for the other two invitations he did not provide any justification. Therefore, in order to ensure the presence of GR, the Special Prosecution of the Republic of Kosovo has filed a request with the Basic Court of Pristina to issue an arrest warrant against him,” she said.

Rakiq’s location makes it impossible to investigate there.
Because, according to lawyer Ardian Bajraktari, Serbia has no legal cooperation with Kosovo to bring Rakici to justice.
“It is the duty of the Police to then execute the same in case he is eventually encountered within the territory of Kosovo, he will be arrested and brought before the justice authorities. However, when we are dealing with such cases, in quite a few cases it has resulted that the same ones can exploit our northern neighbor who is not willing to cooperate with our authorities, then the issue of international legal cooperation comes to the fore”, said Bajraktari.
According to him, for the criminal offenses charged against Goran Rakić from the Serbian List and 11 other people, the trial in absentia cannot take place.
“Currently, the person is in the investigation phase, it remains to be seen how the procedure against them will go, due to the fact that it is important to establish that for this category of criminal offenses, the procedure cannot be conducted without them being present to face charges, therefore, a trial in absentia for this category of criminal offenses cannot be conducted,” Bajraktari said.
So far, the Special Prosecution has interviewed the current leader of the Serbian List, Zlatan Elek, and two members of parliament, Slavko Simić and Igor Simić.
The Special Prosecution has requested arrest warrants against 11 other people.
