109 acquittals in the Saraçhane case involving 110 people!

At the hearing of the Saraçhane case with 110 defendants, the judge decided to acquit 109 defendants. Since the requested images did not reach the court, the file of 1 defendant was separated.

A total of 110 defendants, mostly young people, who were sued for participating in the Saraçhane protests that started after Istanbul Metropolitan Municipality (IMM) Mayor and CHP’s Presidential candidate Ekrem İmamoğlu’s university diploma was canceled on March 18 and taken into custody the next day, appeared before the judge for the second time.

The court acquitted 109 defendants. The file of 1 defendant was separated because the requested images did not reach the court.

In the decision, references were made to the decisions of the Constitutional Court, ECHR, Law No. 2911 and the General Criminal Assembly of the Supreme Court of Appeals.

WHAT HAPPENED?

An indictment was prepared against 110 people who were detained on March 26 and 27 on the charge of “Participating Unarmed in Unlawful Meetings and Marches and Failure to Disperse Spontaneously Despite Warning” on the grounds that they participated in the Saraçhane protests.

According to Article 34 of the Constitution titled “Right to organize meetings and demonstrations” “Everyone has the right to organize unarmed and unassailable meetings and demonstrations without prior permission.”. Therefore, it is not necessary to obtain permission from the competent authorities to hold meetings and demonstrations.
