It’s interesting how if people get into a fight with someone punch them once and they die you’re charged instantly with man slaughter.

Do something worse in a vehicle though? Which requires constant decisions to continue to do because you can pull over any time?

    Horrific accident.

The mother of the child – who was not driving – seems to have been given a suspended sentence for manslaughter by gross negligence for not strapping baby Harry into the car seat.

It would appear that the courts have ruled that the crash would have been survivable had the mother bothered to strap her child into the car seat, which may explain a sentence that feels lighter than it should.

    I think they’re both shits.

EDIT: Judges [remarks from the mothers sentencing confirm it.](https://www.judiciary.uk/wp-content/uploads/2025/07/R-v-Morgan-Kiely.pdf)

    >Harry was not secured into the child seat at all. The internal harness was simply not attached. Nor was the child seat properly strapped into the car using the rear seat belt. I am satisfied so that I am sure that you simply draped the seat belt around the back of the child seat and plugged it in.

    >2Given that I am applying the criminal standard of proof here, I find that this was a one-off failing. I cannot be sure that it was your practice to do this. Indeed, the evidence is that you normally travelled with Harry in your nan’s car where the Iso fix base was left. That is easy to use.

    >You told the police at interview that you did know how to use the child seat without the iso fix base. Either you did, and failed to follow the correct procedure on this occasion, or you did not, and failed to take steps to find out how to use it. Your responsibility is the same either way.

    >The accident happened probably two minutes or so after the car left its parking space on one of the roads perpendicular to the sea front. Stevie lost concentration, hit a parked vehicle, and the geometry of the accident, in circumstances where Stevie’s speed was not excessive, led to the car rolling over onto its roof. Harry was thrown out of the rear car window and probably died instantly from catastrophic head injuries.

    >It could of course be said that you, Stevie and Harry were desperately unlucky. This was not an accident that was likely to happen. Maybe 99 times out of a 100 the car would not have rolled over at this sort of speed and Harry would have survived.

    >It is a sad and tragic fact that accidents like this do happen in unusual circumstances and as a result of what some would call bad luck. However, the reason why precautions need to be taken is precisely because one cannot assume that luck will always turn out to be good.

  3. > ‘It’s a sad and tragic fact that accidents like this do happen as a result of bad luck.’

Nah its more idiots who put partying first and don’t care about the consequences of their actions than bad luck. She chose to drink, she turned down a lift and then drove a car and crashed, 100% her fault and 100% preventable.

If you choose to drink and drive and kill someone it should automatically be classed as manslaughter and a sentence imposed

If you are a passenger and allow someone to drive you then you should be equally culpable

As for not strapping the child in, I hope she doesn’t have any more children

Do judges hand out lopsided sentences on purpose, to like instil another layer of hopelessness into society at large? when can we ever get a break and feel some sense of fair play in the world. This woman’s actions led to the death of a child. She would have rather been out of her right mind on booze, than care for her child. This is the sentence that is supposed to reflect her massive failure that ended in death? This is supposed to be what a fair punishment in a just society looks like?

  6. And suddenly I want to cuddle my 6 month old niece all the more.

Such a precious age, completely innocent, inquisitive little things. But these two pieces of absolute human detritus snuff out any potential of what Harry could’ve done with his life. Sad.

  7. I know a couple with 2 babies who have never once used their baby car seat: the father drives like an absolute maniac too.

A friend reported them to the police and told them where to catch them on their daily blitzkrieg through town but they said ‘we can’t act unless we ….. catch them’.

  8. Driving whilst drunk should be attempted murder charge for wvery person you pass and if anyone killed then full murder.

There is no need for it

The judges comments are abhorrent: ‘It’s a sad and tragic fact that accidents like this do happen as a result of bad luck.’

No. Bad luck doesn’t come into it when you’ve necked 3 bottles of wine with your mate just hours before getting behind the wheel with your baby onboard. It’s not bad luck, it’s inevitability.

Imagine if she had slammed her car into one of the judges loved ones… Will it still be ‘bad luck’ then???

  10. I’m sorry but isn’t it the drivers fucking responsibility to ensure their passengers are all wearing a fucking seatbelt, or in this case, strapped in correctly?
Also to not be fucking drunk??

Should we just give up with our criminal system? At this point, we may as well just have a free-for-all.

  12. >’It’s a sad and tragic fact that accidents like this do happen as a result of bad luck.’

It’s not bad fucking luck, this is a disgusting way to look at it. Putting my baby in the car means going through a safety checklist every time, that doesn’t make me lucky, it makes me competent.

  13. Another day, another example of a selfish, ignorant, angry prick of a driver getting away with killing someone. How on earth are they not in jail and banned from driving for life is beyond me.

    Justice Robert Gray needs sacked.

This was not an unfortunate accident, it was neglect and death due to poor desisions.

Who the frick buys 3 bottles of wine for 2 folk and a baby at the beach! Scum, absalute scum behaviour

  15. DigginLifeSince94 on

Let’s not forget that this drunk driver is also a mother. In a way, locking her up would leave a child without a mother.. not sure if we should be punishing a second child in this sad and tragic story.

  16. The sentencing guidelines around drink driving need sorting. There is no excuse for it, it is well documented through campaigns and in the drivers theory test.

Personally I feel the starting point for anyone caught over the limit should be in line with assault with a deadly weapon and escalate from there if any person is hurt or for extreme amounts in the system.

  17. > Mr Justice Robert Jay said the incident was ‘undoubtedly a tragic case’, adding: ‘It’s a sad and tragic fact that accidents like this do happen as a result of bad luck.’

It wasn’t bad luck, it was criminally bad judgement, the number of opportunities they could have taken.

    * Accepting a lift.
    * Fitting the car seat properly, and strapping the baby in.
    * OR NOT DRIVING WHILE DRUNK

I’m actually shocked by this. She should have had a custodial sentence. 3 bottles of fucking wine! That poor poor baby 😞

  19. Embarrassed_Grass_16 on

I don’t know why criminals don’t all just chug a bottle of wine before committing anything. Seems like a get out of jail free card

  20. Poor, poor baby. As a recently new father the pain I feel for this child is immeasurable. How some people can be so selfish to take a life like this. Unbelievable. Some people do not deserve children.
