Ban on leaving the country due to debt

Everyone knows that freedom of movement, which is a constitutional right in Azerbaijan, can be restricted even for an unpaid debt of 100 manats. With the latest changes made in June 2025, as soon as the court makes a decision, the exit is prohibited immediately and the debt is not taken away until it is fully paid on the execution document.

As soon as the executive officer makes a presentation to the court regarding the ban on leaving the country, the Court usually enforces the decision within the same day (such issues are considered without a meeting and signed by the judge).

It is as if the enforcement officer uses it as a means of pressure, regardless of whether the debt is not paid for an excused or inexcusable reason. So, the debt goes to direct execution (in recent years, if the debtor objects to the debt, he goes to court, and the debtor is given 10 days for this), and the execution demands the debt within 10 days, if it is not possible to pay the debt, mandatory enforcement measures begin, and the first thing is to look at the salary and property, if it is not available, it makes a presentation to the court about the ban on leaving the country, and tomorrow the court bans it. That’s it.

there is such a thing in European countries, but it is applied when the amount of debt is very high. Even in Turkey, this is rarely fulfilled if the debt is high.

So, I was fired for problems a few months ago, I couldn’t pay the debt to the bokt. It was about 1700 zlotys after interest fines on the debt. They also give it to the execution. I didn’t know about this case either, I had to go to Dubai for work, I accidentally saw the enforcement case opened in my name, and let’s see that the enforcement officer made a presentation about the ban on access to the court, but since it’s Saturday and Sunday, I have 2 days in short. I borrowed money from acquaintances and went to Nakhchivan and from there to Turkey by land. I told the company that buy me a ticket from Istanbul and I will go there. In short, if I didn’t see it, I wouldn’t be able to leave the country due to that 1700 Azn. Of course, the court signed the ban before 12 o’clock on the first day of the week, and it took effect immediately. However, if I go abroad, I would pay the debt as soon as I get a salary. Of course, it is necessary to pay the debt, but now sometimes it may not be possible. It is a human condition, the right given in the constitution should not be limited without a very serious reason. Banks give loans at 35-40 percent and still pressure the government to oppress citizens. It’s a shame.
