Quick little PSA for everyone.
We all know that parking inspectors aren't exactly the most adored individuals – however, I was under the assumption that they understood the laws and regulations of which they rely upon for their livelihoods. Clearly not.
I woke this morning to a street doused in 102$ fines (including my car) that are… not applicable.
VICTORIAN STATE LAW (Road Rule 318(3)) stipulates that PUBLIC HOLIDAYS VOID PARKING RULES IF there is a day range listed; I.e 7am-8pm Mon-Sat
If no days are listed (I.e 1P 6am-9pm) parking rules apply. If explicitly stated on sign that limits apply during public holidays, conditions stand.

Do not blindly pay for these fines. Inundate the council with appeals.
Make sure to:
– Take timestamped photos of your car, the parking fine & sign
– Appeal immediately

Copped one myself yesterday in Elwood, all day parking….. just a blatant revenue raising attempt.
They should have to pay a fine for bogus fines
So not on. I’m sure they do it because some don’t know the exact rule and will just pay it.
Interesting and outrageous, thanks OP! Are you able to please post a photo of the parking sign for where you were parked?
If you’ve got the time just wait for it to go to court, they don’t generally like having their time wasted and the councils will hopefully get beaten into line to fix their shit.
Was the fine issued this morning (public holiday) or Sunday (not a public holiday)? You say you woke up to a finne, which is why I am clarifying.
Do parking inspectors work on commission??? Why would they do this if they know it’s all gonna get thrown out?
Port Phillip was probably one of the Councils that contracted out their enforcement responsibilities. The contracting companies usually have very poor training and are on a bonus system in relation to infringements issued. Everyone should elect to have their matter heard in court and request costs.
I once received a local-law ticket for dirt on a footpath. We had a permit for a skip, the footpath was closed, the bobcat and labourer were still digging out the garage and dumping soil into the skip. You could see all of this from the officersown photos. I wrote to them sarcastically asking where I could have hired a hovering bobcat so it didn’t touch the footpath. The ticket was withdrawn.
Thanks for the PSA. Hoping this helps the unaware. This is exactly why I built my app, to help people find legit parking and dodge the inspectors. Hopefully with a bigger user base I can get community updates like this to keep the app up to date
FYI it’s actually state law not just up to individual councils.
Road Rule 318(3)
If information on a traffic control device that is at a place indicates that it applies on a particular day of the week, the device does not have effect on a day that is a public holiday for the place unless information on the device states otherwise.
Example
If a loading zone sign indicates that it applies on Monday to Friday between 9 a.m. and 4 p.m. and information on or with the sign does not indicate that it applies on public holidays, the sign does not have effect on any public holiday falling on a Monday to Friday.
Ah yeah, got pinged in a spot not marked with days of the week on a public holiday recently in Port Phillip. Lesson learnt!
