Absolute American hostility towards the ICC has been baked in from the very beginning. Clinton deliberately fumbled getting it through on his watch and I don’t believe Gore would have been successful at making it stick. Even Obama and Biden adopted a tolerant approach rather than an accepting one.
There’s very little the EU can do here. It’s the only large bloc/power (with from the UK, I suppose) interested in upholding the Rome Statute, and if you asked half the eastern flank they’d hate it too, they just consider it irrelevant to their interests. There’s very little the EU should do here. Pretending the ICC is international law doesn’t make it so.
Honestly, getting involved in the Palestinian crisis was the worst thing that the court could do. Leaving aside the Israelis, indicting people who don’t recognise the existence of the ICC for alleged crimes committed in a state that the American government considers a fairy tale was the sort of thing that any president would hate. We’re talking about people who have an actual law calling for the invasion of the Hague if Americans end up on trial there for any reason.

This is not a battle europe should pick. We have enough on our plate as is.
Nothing is going to happen anyways so everything this court does related to israel will end up being performative. No european state is going to enforce the warrant. Netanyahu has already been assured of his safety in the event of his visit by several states.
If he would somehow be arrested by a european state, america would be very pissed. They would certainly use their the hague act. Almost every senator would be in favor of this as their aipac connections ensure this.
Just drop this whole act. It is futile. Let’s reserve our very limited political capital for things that actually matter to the european people.
