
No one is above the Constitution.
This week the Constitutional Court suspended a provision of the Reception Act. Nevertheless, Minister of Asylum and Migration Anneleen Van Bossuyt announced that the policy will be continued unchanged, based on a different legal basis.
According to several academics specialized in migration, human rights and constitutional law, this reasoning raises serious questions. In an opinion piece they point out that the legal reasoning of the Council of Ministers has clear gaps.
The debate here is not just about migration policy.
When a judgment of the Constitutional Court is suspended, it is a binding decision. In a democratic constitutional state, such statements are respected — regardless of whether a measure is considered politically desirable or “effective”.
The rule of law only works in one way: no one is above the Constitution.

Manneke toch, u kent blijkbaar de grondwet niet. De maatregel is niet effectief. Als u dit wenst te bewijzen dan moet u dit in de rechtbank doen, mijn gedacht! En uw tabloid opiniestuk hier droppen apprecieer ik niet.
