As already said here a few months ago (to which, unfortunately, only Scuderi’s office responded), this proposal continues to go strongly against theArticle 7 of the Charter of Fundamental Rights of the European Unionwhich I find very clear:

"Everyone has the right to respect for their private and family life, their home and their communications."

And also againstArticle 8 of the same, dedicated to the protection of personal data, which establishes that:

"Everyone has the right to the protection of personal data concerning them."

Without talking about theArticle 15 of our Constitutionwho quotes:

"The freedom and secrecy of correspondence and any other form of communication are inviolable.
Their limitation can only take place by reasoned act of the judicial authority [cfr. art. 111 c. 1] with the guarantees established by law."

Having said that, at this point why don’t we organize something else?

Propose and vote on a new European law which, on the basis of those principles, prevents the proposal of other laws that could invalidate or undermine the sovereignty of the digital data of private citizens.

So I was thinking of something in complete contrast that would also delegitimize this approach and focus more attention on the real technical debate on the protection of minors. A sort of stake, a huge middle finger against the Big Techs who want to have a say in our damn private data with the excuse of protecting minors, given that the criminals, in that area, I believe already move above standard communication and where only dedicated investigations can really make a difference.

Ignorantly I ask the more experts, students, professors. of the sector, whether something like this is feasible at a legislative/legal level, whether it is technically feasible.

And b4 "eeehhh but we need Federal Europe with its own Constitution" / "In Democracy you can propose anything, it would still be an illiberal move". Ok, but shall we start talking about it in the meantime? 🤔

I am also willing to discuss it by telephone with interested local European politicians, but also in person to create a debate with them.

Maybe a similar project already exists and I don’t know, so tell me in the comments in case 🤷‍♂️

  2. Lo ripeto: vogliono proteggere i minori dai pedofili? Basta mettere chat control esclusivamente sui cellulari di politici e imprenditori di alto profilo. Problema risolto.

  3. Non ho capito, vorresti proporre l’introduzione di una legge che sulla base di altre leggi impedisce di fare una legge che vada contro quelle leggi? Non è ridondante?

    Io penso che si stia cercando in tutti i modi di introdurre strumenti più avanzati di sorveglianza di massa perché mancano solo qua, e lo stiamo facendo con la scusa dei pedofili. Credo questo perché ChatControl è una presa per il culo talmente grande da ritenerla offensiva per l’intelletto, anche di un umano non tecnico.

    Perché secondo loro, se passa una legge del genere, il pedofilo va a fare il pedofilo proprio sullo strumento posto sotto osservazione? Ma chi ci crede a sta boiata?

    Dovremmo batterci per l’anticorruzione piuttosto, perché qui c’è palesemente qualcuno che prende mazzette per spingere questa e altre minchiate. Guardacaso di quello non se ne sente parlare mai eh.
