Hello team, since bad experiences with real estate agencies are often written about, I think it is important to draw attention to the new amendments to the Law on Real Estate Brokerage.

The Parliament accepted the changes that finally put an end to some "wild" practices. Here are the key items you need to know if you are going to view the apartment:

​1. No more blackmail before viewing (Art. 23)

​The agent may no longer require you to show the property by signing an agency contract.

​Viewing certificate: It is still signed, but it serves solely as the agent’s proof to his principal (seller) that he has done the work.

​Important: According to the law, this confirmation is not considered a contract and must not contain provisions obliging you as a third party to pay a commission.

​2. Advertising prohibited "in black" (Article 22)

​Agencies are no longer allowed to advertise properties for which they do not have a signed written brokerage agreement with the owner. If you see an ad, the agency must have paper for it.

​3. Advice for buyers

When you are at the location, feel free to ask the seller in front of the agent: "Do you have a mediation contract signed with the agency?".

​If they don’t have them, the agency shouldn’t advertise or mediate at all.

​If they have, the seller is the one who hired the agency and he is the principal who pays for the service, unless you yourself hired the agency to search for you.

​In short: The agent must not turn you away at the door because you did not want to sign "commission paper" from 2-3%.

    Ovo je super, nama je nedavno jedan agent htio to uvaliti kao oni nas prate kroz proces kupnjeblablabla provizija 2%, samo smo rekli da necemo i odustali bez razgledavanja. Mislim meni je to umobolno, nasli smo oglas na njuskalu jednako kao da ga je stavio vlasnik, nije agencija meni trazila nekretninu po mojoj zelji pa da im placam proviziju.

    Iskreno treba im i zabraniti provizije od kupaca. Ako je osobi A lijeno samoj ici u proces prodaje, neka plati agenciji toliko i toliko. Ne razumijem po kojoj logici kupac treba njima platiti 2-3% jer je sam kliknuo na oglas i nazvao broj? Koji su oni tocno tu posao obavili za kupca? Jednom smo zvali za neku kucu, “provjerit cemo je li moguca kupnja kreditom” (??? Znaci niti papirologiju nisu rijesili prije oglasa), na kraju mi je agentica dala broj vlasnika da bi mi vlasnik rekao nema uporabnu. 1% provizije za sto tocno onda? Jer su okacili oglas na njuskalo?

    Jedino kad bi platila agenciju je da mi onda oni gledaju oglase i traze ponude po onome sto meni treba.

  3. >​Agent vam više ne smije uvjetovati pokazivanje nekretnine prethodnim potpisivanjem ugovora o posredovanju.

    Naći će drugi način da vas otkantaju, legalno.

    Ak hoce prodavat nekretnine, nek ih kupe pa onda preprodaju.

    Ovak, sjedit ko paraziti na transakciji, i mi to dopustamo, je suludo.
