BIRMINGHAM, Ala. (WBRC) – Central Alabama Water can carry on with business as usual after a federal judge denied a request to freeze the changes the board have made at the utility during the last 11 months.
The lawsuit was brought by former Birmingham Water Works Board employees William Muhammad and Brenda Lewis. It was similar to one brought by the City of Birmingham.
An attorney representing Muhammad and Lewis said the Alabama Legislature went too far when it passed a law taking over the utility.
“All of this was owned by the citizens of Birmingham, so if I buy Apple stock and Apple blows up and everybody else starts to buy the stock, you can’t tell me I got to give up my board seat just because the water happened to be good enough that everybody else wanted it,” said Attorney Calvin Grigsby.
A hearing for both federal lawsuits has been scheduled for May 2026.
