There shouldn’t be any risk involved. We should send those that choose to commit crimes back home. But to the legal system it’s seemingly too controversial. It’s sad.

    2. Call me when executives at Walmart get arrested and charged with wage theft.

    3. It needs to be illegal to consider immigration status in criminal cases.

Also how come everyone but idiot judges realizes that criminals are the last people we want as immigrants to this country.

Another day, another slap on the wrist due to ‘potential immigration consequences.’ So frustrating that it feels like there’s nothing anyone can do.

Being a temporary resident should be an aggraavaating factor not a mitigating factor.

They are visitors here and show zero respect for the law.

    6. On one hand this person deserves deportation. On the other hand, Walmart deserves to be stolen from by hiring foreign labour to do the jobs that Canadians should be doing.

That isn’t right. I think that any noncitizen who commits what would an Indictable Offence, or certain Hybrid Offences, should immediately be put up for deportation. Some leniency could be considered for Summary Offences, given that people make mistakes, and average people break rules all the time; but I don’t think that it’s unreasonable to remove somebody for higher tier, or repeated, crimes.

Sad to see this is the state of our country honestly. Steals over $7,000 worth of stuff and part of the reasoning for house arrest is the “risk of deportation,” while regular people work hard, pay insane taxes, and can barely get ahead. But hey, elbows up everyone, I’m sure Carney and his experts will tell us this is what progress looks like.

This action by Canada, is against what ice is doing in us.

      Legal immigrant here

I couldn’t care less about anyone stealing from big corporations considering they cut hours and wage theft from minimum wage workers all the time.

But I’m tired that IRCC would be on your a** for your employer cutting your hours (I would know, as I have to write 2 page outline on my hours being cut in my application) while lil shiets like this worker commit crime and basically have a slap on their wrist

    11. Immigration status should have no bearing sentencing. The judges need to be removed from the bench

    12. Dry-Wolf6789 on

tbh i dont care if ppl steal from walmart. but i dont understand why you wouldnt be deported after theft of that amount .

    13. leopardbaseball on

Doesn’t this mean that legal system is actually encouraging immigrants to do crime?

These are exactly type of people Canada needs to get rid of, what trudeau’s policies attracted.

    14. These articles really don’t understand immigration law and should learn about it or stop writing about it.

She will still very likely be issued a deportation order. House arrest can not stop that.

All this sentence does is allows her to appeal her deportation to the Immigration Appeals Division. If she got over 6 months in actual jail she would not have these appeal rights.

This judge is just passing the buck to an immigration judge to determine if she should be deported instead of doing it himself.

might be worth it to replace the word *risk* with the word “guarantee”

    16. Oh no, won’t someone think of poor Walmart. Downvote me I don’t care, fuck billionaires.

    17. Article is gated so I can’t read it, but I have to assume that the defense just included in their list of considerations; the same as they always do… and it’s a huge rage batey nothing burger.

Or did the judge actually say this had some bearing on their ruling?

    18. explosive_fascinator on

Why is our criminal justice system doing an end-run around our immigration rules? It’s insane.

Is immigration status giving people more rights than citizen’s a provincial or federal thing? Just wondering where to protest

    20. I am not right wing, but if you are not a citizen here. And are found guilty of a felony. You should be given jail time and then deported and banned. It’s that simple. If you are not a citizen you are a guest.

    21. Outrageous-Estimate9 on

Blame Walmart for using temporary foreign workers

I wont shed a tear for their losses

    22. Suitable-Broccoli264 on

Meh, it’s a crime against a business and not a violent crime against a person.

    23. We’re a laughing stock.

I just read about the Tourists from Chile. People are literally visiting Canada to commit Tourism crimes.

If they get caught elsewhere they do serious crime. If they get caught here it’s community service and a stern warning never to do it again.

    24. TheSleepyTruth on

Judges who give more lenient sentences *specifically* to skirt enforcement of immigration laws should be removed from the bench. A judge’s entire job description is to enforce the laws as written… not find ways to flout immigration laws and evade the intended enforcement mechanisms. These are partisan political activists not judges.

    25. I came to this country in the late 90s as a teen. I was told by other kids who where also immigrants how easily we could get sent back if we broke the law. Seeing all of these stories about immigrants not following the laws and how Canada gives preferential treatment to criminals, it breaks my heart. It also shows that if you want to do crime, you can come to Canada and have zero consequences.

    26. abc123DohRayMe on

We need better judges and better laws. How about protect Canadians and Canadian businesses before foreigners?

    27. TonysAutomotive on

      Canadian Judges should be paranoid.

They should be living in gated communities insulated from the commoners, and protected with the full strength of the state.

Or we could just like bring law back.

    28. Illustrious-Job-6390 on

Why do we want these shitty people here? Over and over every news article features the same people.

    29. Clear-Consequence114 on

Just one day I want to see an article about our justice system and not be horrifically embarrassed

    30. Theft in that range isn’t usually punished severely, for obvious reasons. Poke around online and look at what people usually get.
