LAS VEGAS (KSNV) — A judge has denied a petition filed by the Nevada Attorney General’s Office, asking a Clark County Court to overrule NV Energy’s daily maximum charge rate approval.
The office’s Bureau of Consumer Protection (BCP) filed a petition in December for judicial review with the district court in response to the final ruling issued by the Public Utilities Commission of Nevada (PUCN). However, Clark County District Court Judge Mary Kay Holthus denied the effort this week.
This comes after the PUCN voted to maintain NV Energy’s new demand charge in November.
Attorney General Aaron Ford wrote in a statement, claiming the court “got it wrong”:
According to the statement, AG Ford plans to appeal the ruling to the Nevada Supreme Court.
The demand charge for Southern Nevada customers, introduced in February as part of a general rate case, is a daily fee based on a customer’s highest 15 minutes of power use each day.
NV Energy said that most customers would see little to no change in their bills unless they alter their habits, though solar customers could see their bills go up by about $12.
The demand charge is set to be implemented January 1.
