STAUNTON — A multi-million dollar lawsuit filed earlier this year against Augusta Health Care Inc. after a woman was reportedly injured in a fall at the hospital’s fitness center has been dismissed, court files show.
A motion by the plaintiff to have the lawsuit nonsuited was granted in March, court files show, prompting its dismissal. It can be refiled.
Initially filed Jan. 13 in Augusta County Circuit Court, the plaintiff in the lawsuit claimed she was at the Augusta Health Fitness Center in Fishersville on Feb. 14, 2024, when she reportedly took a hard fall.
The lawsuit said the roof to the fitness center was reportedly damaged at the time and said water would leak onto the facility’s indoor track when it rained, creating a tripping hazard. Unaware the roof was allegedly leaking, the woman said she was running when she “tripped and fell on the damaged portion of the indoor track.”
Represented by Zachary Grubaugh of the Broughton Law Firm in Henrico, the plaintiff had been seeking $10 million in compensatory damages and costs. An email seeking comment from Grubaugh was not returned Monday.
Kristen Printy, a spokesperson for Augusta Health, said the hospital does not comment on legal matters.
