The devil will be in the detail here – will those who have arrived on HSC visas be able to extend the now nonexistent visa or be forced to apply for regular work visas?
Will those who arrived under the ridiculously low salary thresholds set out by Boris have to reapply under the new, high salary thresholds when their 1 or 5 year work visa’s expire?
If they have to apply under the new salary thresholds many will not meet the new thresholds and either have to leave or become illegal visa overstayers. If this is the case it’s hard to overstate just how significant this law will be – it would be effectively a remigration policy.

I know this sub has quite an anti-migrant bent, but this cohort of people are those who are currently on Skilled Worker Visa and work here with the expectation that they’d get ILR after 5 years. Most of them aren’t getting ILR for benefits (the salary and wealth thresholds for the visa itself typically bar them from getting benefits anyway), but to have a sense of security so they can move in and out of this country as they please and to stop paying Home Office thousands to work in the UK.
By applying this retroactively, the government is shattering the life plans of hundreds of thousands of people here, who have moved here with the expectation that they don’t need to renew their visa to get ILR.

If they say that if you’re not contributing then it’s a longer wait, but if you’re paying taxes and working and speak English it’s still 5 years that sounds fair. Extending it to 10 years unless you’re “exceptional” feels unfair. It’s too long to leave someone in limbo. It’ll also make it more difficult for people to get mortgages and buy a house. Plus it’s a lot of money to keep renewing visas. Also applying it retroactively is as they say, a dick move.

I’m on a visa and paying additional rate of tax. Been looking forward to 2027 to settle and finally buy a house. Unfortunately if the UK tells me I’m not welcomed here, I’ll have to go elsewhere more accepting and pay tax there. Womp womp.

I find strange an assessment saying “this move wouldn’t bring number of ILRs down but would raise more money”. It absolutely would. Any sponsored tier2 migrant is very dependent on their sponsor and if something goes wrong on the job front – would be totally screwed. It is tolerable (barely) when it is 5 years, it is not tolerable to be 10 years. A lot of people would decide not to risk that.
Now it sounds completely cruel that someone wants to apply that retrospectively to the people already in the UK, and I do believe they target wrong cohort.

The question i have is: does this impact my EU Settlement Scheme? I am getting settled status this year, which is equivalent to ILR (although my pre-settled already grants me the same conditions to a UK national except the ability to vote for general elections).

Fair play Keir, this is good stuff. Offsetting the Boriswave and doing whatever we can to limit the long term settlement of it is pretty much the biggest issue facing the nation.
Hopefully another nail in the coffin for the Tories as well and a reminder of their disgraceful immigration binge.

My friend has been in the UK on a Tier 2 for almost 5 years and could apply for his ILR this year. If the new policy comes into effect this year he has to wait another 5? He’s been working and paying taxes for almost 5 years lol. What a shambolic thing Labour are doing.

My wife (Vietnamese) is married to me (British citizen by birth), works hard, pays all her taxes, and the extra surcharges. Family here who are long settled and have full British citizenship, etc.
We can afford it, and to be honest barring any disaster, the only downside to ten years instead of five would be the pain of dealing with the fucking EU when it comes to tourism visas, but even there she’s now getting year-long ones as opposed to the two weeks they originally were giving her, and that could go up to two-years or more.

It’s disgusting to add it to people already here on a visa, people who’ve made plans for it to be 5 years. People who might have a few months left for ILR when this comes into play, now have to wait another 5 years
Whenever new requirements are introduced, it’s only applied to new applicants for a reason. It is completely unfair to make it apply to everyone already here.
