I rented a motorcycle (CBR500R) this weekend in Leipzig and saw that the mietvertrag states values for certain fees higher than what is mentioned on their website (at the bottom of the webpage). For example, the Selbstbeteiligung mentioned on the contract is 2000 Euros but their website clearly says that amount is only for new licence holders which I am not. Another thing they have mentioned is flatrate for Benzin/Reinigung/Sonst. is 40 Euros but on their website it mentions 20 Euros. The motorcycle is not damaged in any way, I have wiped it clean, filled the tank fully even though I was given it at 80% filled and I am well within the km range allowed for the rental. I will be returning the motorcycle in a couple of hours and wanted to know how best and politely (but assertively) can I bring this up with the rental and not be pressured or scammed into paying for something that is clearly unfair. Also what are my rights as a consumer and who do I need to contact in case they charge me unfairly? Thanks in advance for your inputs!

    What makes you think that anything written on a website is legally more relevant than a contract you’ve signed?

  2. Ask them to explain the 20 € difference when you hand it in.

    Whatever the explanation is, for only 20 € I wouldnt lift a finger. It’s not worth the time and nerves.

    I’m not a lawyer, but if you signed a contract with different conditions, those are the conditions you agreed to. Those are conditions you should have looked over before signing any rental agreement.

    Maybe someone else can give better advice on asking them if there was a mistake and if they can revise how much you have to pay (if the insurance was, for example, higher than it should have been or the cleaning costs), but if the were to give you any refund, it would be out purely out of goodwill 

  4. Pacta sunt servanda.

    It counts what is in the contract. You should’ve brought things up before signing it (especially stuff like the 2k€ Selbstbeteiligung).
