A group of Swiss businessmen show up in the Oval Office without an official mandate, give Donald Trump a Rolex and a personalized gold bar, and shortly afterwards the US government lowers tariffs for Switzerland.

Alle Geschenke über ein paar hundert Dollar sind automatisch Staatseigentum in den USA.
Die gehen in den Besitz der Presidential Library über.
So auch der Tisch im weissen Haus und viele weitere Ikonische Dinge dort.
Geh doch mal an die frische Luft und rege dich weniger über solche Sachen auf.
Da es sich um Trump handelt wird genau nichts passieren.
Zumal du auch gerne Chat GPT fragen kannst, wo das Schweizer StGB zur Anwendung kommt.
Das sollte dir auch erklären, warum die Bundesanwaltschaft nicht darauf reagiert.

Ich bin auch der Meinung, dass es sich klar um Bestechung handelt.
1. Territorialitätsprinzip: wennschon dann wären die US-Behörden zur Strafverfolgung verantwortlich, nicht die Schweizer Behörden.
2. der Tatbestand ist schlicht nicht erfüllt. Eine Bestechung im Sinne des StGB liegt vor wenn *dem Bestechenden* unmittelbar im Zusammenhang mit der Bestechung ein ungebührender Vorteil gewährt wird. Dem Staat Schweiz einen besseren Zolldeal anbieten erfüllt das nicht, da a) der Vorteil nicht einer einzelnen bestechenden Person gestattet wird und b) der Vorteil an sich auch nicht ungebührend wäre in diesem Fall.
fazit: Tatbestand hinten und vorne nicht gegeben.
Wie soll man sonst mit Amerika Geschäften??? Bleibt mal realistisch
Das Schweizerrecht kommt im Ausland erst zum Tragen, wenn Straftatbestand international verfolgt wird oder beim Flaggenprinzip. Ansonsten höchstens Versuch könnte geprüft werden, aber die Tathandlung als auch Erfolg ist im Ausland geschehen. Wenn aber USA die Schweizer strafrechtlich verfolgen würde, könnte die Schweiz dasselbe tun. Ich glaube höchstens Verrat könnte einschlägig sein.
Ist ein Geschenk und ob das trump als solches deklariert ist ihr Problem. Ich verstehe die ganze diskussion nicht. Es ist ein Geschenk aus der Privatwirtschaft und es ist nicht bekannt dass der Schenkende eine besondere Kondition explizit für sein Business Heraushandeln konnte.

Das Geschenk war an Trump’s Presidential Library und nicht Trump direkt. In den USA ist dies legal aber ich denke gemäss Schweitzer Gesetzt ist das immer noch illegal [1]. Es sollte wenigsten untersucht werden.
