The accused probably acted out of self defence and fear of life, especiallyif he was jolted awake by suspicious noises in the middle of the night. He certainly shouldn’t be found guilty. On all accounts, his life has been jeopardise through the actions of others.
Why is his wife (hopefully ex- by now), not on the stand instead?
Looks like a clear-cut case of guilty as charged. Yes, sure, he woke up, heard a noise in his own home, grabbed a gun for self defence, and went to investigate, and found an intruder on his balcony. At that point, the question is, did he have any reason to suspect his life might be in danger? I rather suspect the typical guy who has just had sex in a stranger’s home probably isn’t carrying any weapon sturdier than a freshly deflated meat sword. It doesn’t seem to be self-defence so much as uncontrolled rage brought on by the realisation that he had just been cuckolded.
And yes, it is perfectly true that neither the wife nor her lover painted themselves in glory in this sorry affair. But their shame doesn’t vindicate his crime.
Crazy to see that there are people who think murder is justified. When God said “Thou shalt not kill,” DID HE STUTTER?

u/WhatsHeBuilding Maltese courts are notorious for the time it takes most anything to go to trial, and then they take ages to go through the court process too.
Sometimes people are remanded in custody before trial and then have to be let out on bail because of how long they were in prison even before their trial began, not convicted but still in jail for a year without even going to trial. Given how long he has been waiting for his trial you think he should have been locked up without being convicted?
What needs to change is the efficiency and timeliness of the court procedures here.
Either way isn’t fair, if innocent it isn’t fair to be held in prison or on bail for that long, if guilty, it isn’t fair to the victim(s) or their friends and family that the perpetrator(s) are left walking free on bail for that long before any justice is seen.
In this instance if he is found guilty he could have been convicted within a year or so of the murder happening, if he’s not guilty he could have been acquitted in a timely manner so as to not have the criminal case hanging over his head for this long.
Police and criminal courts here are pretty much all a bit of a farce.
Edit: as to the wife, having an affair is not illegal, don’t be a dip shit…would you have any man on trial if he was the one who had an affair? We have no knowledge of what she did or didn’t say / do when he took the gun out but frankly even if she didn’t say anything she still didn’t murder anyone.
…and if she didn’t say anything maybe she was frightened of the man with the loaded gun being told she just slept with another man 🤷♀️
