    Crans-Montana – Should “major” cases be taken out of the hands of the cantonal judiciary?

      Not if the cantonal judiciary is unable to handle things.

      What I do observe though, is an insane level of nonsensical bashing based on… nothing but clichés. (And italian far right ambitions)

      Well, what legal criteria would you use to define “major” cases? Because without such clear criteria, the decision could still be quite a bit arbitrary, IMHO.

      And who should handle such “major” cases then? Another cantonal prosecutor (of which canton / who chooses the canton?) or the federal prosecutor?

      Maybe it would be better to mandate that as soon as former or current local (communal or cantonal) authorities/officials (could) have committed criminal acts, then the case should either be handled by another canton or the federal prosecutor.

      But the problem for the Crans-Montana case would then still be that you might need to hand off the case after the investigation (evidence gathering, interrogations, etc.) has already begun. I mean, it has been now 4 weeks (and the investigation file is probably already huge) before they have decided to treat the former and the current municipal security officer as suspects.

      So, for Crans-Montana, handing off the case to another prosecutor office (other canton or federal) *at this point in time* could actually further complicate the case (new prosecutor has to “start (partially) from scratch” and first needs to read all the files, “connect the dots”, etc. which leads to further delays), or even lead to subsequent mistakes (attributable to the “late-hand-off”, loss of knowledge, etc.)

      I mean, it’s not like in cases of e.g. the cantonal police/prosecutors (potentially) committing criminal acts, where it’s quite normal to hand off the investigation to another cantonal prosecutor *from the start*.

      No. We need to find a way to ensure that cantonal judiciaries are competent and resourced to do their work properly.

      If one agency has to investigate another? Yes. I don‘t trust any canton to not have some internal ties preventing them from being impartial

      I am not sure in general, but in this case absolutely yes.
      There are enough reports on how corrupt and full of nepotism everything is in Wallis.

      If this event wouldn‘t have gotten the international attention, this would have already been covered up and vanished somehow.

      It’s clear the authorities were overwhelmed in this case, and already made serious mistakes that will affect the investigation.

      Considering the costs of this case could eventually become a burden for the Canton as well, I personally believe there is a conflict of interest and that there should be a neutral body which oversees the process.

      Yes, they are either incompetent or a cover-up, they did not even secure the CCTV of Jan 31st, it’s lost.
