The words of Mattarella, who this morning surprisingly presided over the plenum of the CSM:

[Il Csm] in its functioning, it is not free from defects, gaps and errors and criticisms of which are obviously not precluded. As, indeed, there are defects, gaps, errors and possible criticism regarding the activity of other institutions of the Republic, be they – he underlined – part of the legislative, executive or judicial power.

I am aware – he continued – that the presence of the President of the Republic for the ordinary work of the Council is not usual. As far as I’m concerned it has never happened in eleven years. I was led to this decision by the need and desire to underline, once again, the value of the CSM’s constitutional role.

In this forum, which must remain strictly institutional and extraneous to issues and controversies of a political nature, more than for the functions of president of this council, as president of the Republic I feel the need to firmly renew the exhortation to mutual respect at any time, in any circumstance, in the interest of the republic.

The President of the Republic presides over the CSM by Constitution (art. 104 Cost.), and although obviously many of its functions are often delegated, there are those who remember, as in this article from the Italian Association of Constitutionaliststhat its role is not purely cosmetic:

We also know that the CSM Presidency is not a “formal” Presidency. Multiple provisions of law no. 195 of 1958 assign the President tasks that could place him at the center of the concrete dynamics of the body (or, in the future, of the bodies): not only because – as is known – he must give his consent to the formulation of the agenda, but also because he might want to supervise the composition of the internal commissions, he would like to be able to preside over the Disciplinary Section, he could exercise the power to dissolve the body.

The practice has consolidated in the sense that the President, while delegating the Vice President, carefully follows – also through his offices – the work of the Council, but “from afar”, avoiding entering directly into the council dynamics. The most sensitive issues are discussed informally and it is therefore essential that there is harmony between the President and the Deputy.

If it passed justice reformthe President of the Republic would continue to preside over both distinct CSMs (but not the new disciplinary High Court).
