

I assume it thought my right arm is looking a bit like I'm holding a phone, but;
(a) even if it was, the phone is not visible. You can't base a fine on positioning.
(b) my left hand is not even on the wheel, obviously my right hand is.
(c) you can see the very bottom of my phone plugged into the charger in the center console.
I'm obviously going to appeal this and am confident they will repeal it but it's very frustrating to receive this in the mail and have to go through the whole appeal process based on nothing.

For what it’s worth to you. Your left hand in the second photo looks like it is holding a phone on your lap.
Whether it is or not, I can’t say, but it sure looks like it. I imagine that is why you’ve received a fine notice.
Edit: Some aren’t seeing it so here. It’s got roughly the same size and proportions as a phone. And it looks like it’s resting on his lap with his hand on it/clasping it.
Again, I am not saying it is a phone. I am saying I can understand why it was flagged.

I don’t know how the AI is trained, probably thousands of test runs with the driver saying yes/no to holding a phone, and it’s learnt there’s a correlation between the charging cable going to a hand and a phone being held

I swear I got flashed by a camera the other day because I was holding a cup in one hand while driving.
My daughter was in the passenger seat and thought I was speeding, but I was more than 10km UNDER the limit because I was coming into a 70km part of the highway and she goes “Oh maybe it’s the cup! The cameras use AI now to detect if you’re holding a phone.”
I’ll have to wait to see if I get an infringement in the post
Are you wearing shorts? In the second pic, if you zoom in it kinda looks like your left hand is holding a phone on your leg because of where the shorts end. Now a human can tell that it’s likely to be your hand resting on your leg, but AI probably can’t tell the difference

About 20 years ago I got a camera speeding fine in the mail for a road I had not been on, I assumed it was a mistake.
I had to go to the traffic cop HQ to view the photo, both the cop and I could see it was clearly me speeding.
I pointed out that the road on the ticket was 3 lanes wide, while the photo was only 2 lanes, so the ticket was not valid.
The cop followed me all the way out of the building, waving the photo at me and demanding I tell him which road it was.
Never heard about it again.

Like others have said comparing this to Robodebt is offensive and plainly wrong. This WOULD be like Robodebt if the AI cameras were illegal, if they had legal and departmental advice that it was wrong, that they used one possible breach of the road rules to then go back and assume that you also broke the law on previous driving trips and fine you for those imagined breaches, then sent debt notices of those fines, made it difficult for you to challenges those fines and then garnished your wages to pay said fines.
Unfortunately, even if as many as 1 in 10 fines sent out are AI-induced overreach,
it’s financially hitting the motherlode
for the relevant State government.
