I wonder how the judge would react if they were choked and kicked by this guy on two separate occasions. The judge would probably not be so considerate of all those factors that resulted in a short sentence.

If Carney really wants to convince the Canadian public that he’s different than Trudeau he needs to pass legislation to put an end to this nonsense ASAP.
Also, this activist judge sounds like a fucking idiot that doesn’t value the lives of ordinary Canadians. I wonder if the sentence would be different if the offender lived in his neighborhood.

Is there a certain point when race based sentencing will end? Or is it just indefinite regardless of the actual circumstances for indigenous people.
Like jews from the pale, should we be taking into account how they were economically deprived and targeted in pogroms or has it been long enough?
If you can trace your history to some sort of ancestral trauma, can you use that to explain your current circumstances and get a reduced sentence?

I was half expecting the judge to just blithely drop ‘and you know what the baby was white so probably had it coming anyways’ with this story. The Feds seriously need to tackle the bias in the judicial system.

“K.J.M. stepped into the room and used his foot to kick and move the child away from the door, rolling him into the centre of the room,” the judge described.
“He then bent down and pushed his hand on the front of the child’s neck, pressing him into the carpet. He squeezed the child’s neck for a moment while the child was screaming. K.J.M. yelled, ‘Get away from the f—ing door,’ and then released his grip and left the room, closing the door behind him. The child can be heard crying while crawling back to sit at the closed door.”
A video captured two days later showed the second vicious assault on the innocent child.
In it, the boy, again dressed only in a diaper, is seated on his bed crying quietly to himself and flinches as K.J.M. opens the door and strides into the room to stand next to the bed.
“He immediately squared his stance and then kicked the child once in the face or forehead with his bare foot, causing the child to fall onto his back,” Golinksy wrote. “He yelled something at the child, then stormed out of the room and closed the door behind him. The child continued to lie there on his back and can be heard crying until the video ends a few seconds later.”
That b*stard shouldn’t be allowed back in general public. There is no excuse for hurting a child like that.

How is this even possible. He gets the discount just by being indigenous. Not due to any actual effects of colonization on him personally.
A 33-year-old Indigenous B.C. man who choked and kicked his girlfriend’s “vulnerable and defenceless” two-year-old son last summer has been sentenced to six months in prison for two separate assaults, both of which were captured by a nanny cam in the child’s room.
In her recently published sentencing decision, Provincial Court of B.C. judge Temara Golinsky said that while the man “was not raised with a traditional upbringing,” doesn’t have status and neither he “nor his “immediate family were impacted by state actions such as residential schools, even the dissociation with one’s past and cultural heritage is a negative consequence of colonization.”
As such, his Indigeneity was given some weight as a mitigating factor when she gave him concurrent six-month sentences on charges of choking and assault earlier this month.

>That afternoon, Rattlesnake and a friend were in a bathroom consuming alcohol and methamphetamine while the children were in another room, according to court documents.
>Rattlesnake heard the children misbehaving and went to check on them. She returned to the bathroom shortly afterward and asked her friend for help.
>Nina was lying motionless on a bedroom floor next to a hole in the wall. She had a swollen head and blood coming from her mouth, requiring immediate medical attention, the agreed statement of facts reads.
>No one called 911.
>Instead, Rattlesnake made several phone calls seeking help to dispose of the child’s body.
>When police later located Rattlesnake with her three biological children, she claimed Nina had been picked up by her biological mother. According to court documents, investigators determined that was not true.
>During police interviews, two of the children disclosed that Nina had been subjected to regular abuse by Rattlesnake. They said the abuse was not inflicted on the other children.
>CCTV footage showed another friend arriving at the apartment building with three other people, carrying an empty hockey bag. They later left with the bag, which contained Nina’s body.
>A medical examiner determined that Nina had suffered numerous injuries — some recent, some months-old — consistent with chronic child abuse, the agreed statement of facts reads.
>She was also suffering from sepsis affecting her entire body, likely caused by an untreated broken tooth.
>The blunt-force head injury she suffered on April 22 was identified as the final injury that led to her death. The medical examiner concluded she may have survived that injury if not for her prior abuse and infection.
>Rattlesnake knew Nina required medical care but did not seek treatment, according to court documents.
I wonder why the ideologically prescribed concept of child abuse as a nebulous symptom of “*colonialism*” has been uplifted to the level of unimpeachable fact deserving rulings based on another ideological concept of “*substantive equality*”?
