      Our justice system is a joke. Unprovoked kick and then running off leaving the man to die. How is this not a life sentence? Judges need to be held accountable

      The poor man and his family. There’s no justice there at all. Unprovoked attack on an elderly man. Kills him. With remission he’ll do just over 4 years. I really hope the DPP appeals the severity of the sentence.

      5 years For taking the life of someone’s grandad,father,brother,he’ll either walk out of there in a few years worse than he went in or if there’s any justice left in the Irish system this needs to be overturned and looked at again,a kick to the head,especially on an elderly person,is closer to murder than manslaughter.

      I never thought I’d see an article named “Man jailed after spinning kick cause pensioner’s death”….
      It just sounds cartoonish something you’d see in a video game or bad Hollywood film anyways RIP to the pensioner. As for Joshua Rush: go to hell and stay there

      We need to keep these types in isolation prison. They’re not humans, they’re animals. These types cannot be rehabilitated out of crime – let them suffer til the day they die. 

    8. Is there any other country in europe that would give out a five year sentence for killing an elderly man for the laugh? Even if he just kicked him in the head for no reason but didnt kill him 5 years is laughable. In the USA this lad would be locked up for most of his life

      I’ve genuinely come to hate the Judges in this country. Far too easily manipulated into making bad decisions. 5 years for an unprovoked killing is madness. Should be minimum 20 to life. All you need is a sob story and suddenly you’re almost in the clear

      The government has to toughen sentencing via legislation to stop the bleeding heart judiciary if removing them isn’t an option. And build more prison space so there’s no excuses for this nonsense

    12. I don’t know why I read this article, everything about it just puts me into a foul fucking mood. He did the crime in June 2021 and he’s only getting sentenced now? He’ll be out of prison in quicker time.

      That thug will be released early for good behaviour while the pensioners’ family are deprived of their relative for the rest of their lives.

      One might ask, where is the justice in that!!!

      Manslaughter is such a cop out in cases like this. Intent shouldn’t automatically assuage responsibility for actions. We see a constant avoidance consequences basically on the defence of ‘I didn’t mean to…’

      Wouldn’t let child use that excuse, why do we let grown ass arseholes use it?

      Fuck me do people on this sub ever read the article. The DPP set the charge and the prosecution stated the level they wanted it set at. They made it comparable to a single punch. That decided where the sentence ended up. Nothing to do with the judge. If you have an issue write to your TD about what law changes and sentencing changes you want. Kicking judges on here makes no difference to how this works. The judge even said it should be considered more serious. 6.5 years sounds like where it would end up with no previous convictions or arrests and a range of 4-10 years. Needed to be set at a higher level in the first place.

      He should have gotten extra for his defense. He said the victim was drunk. IMO that makes it worse (if it’s true). Not only was he a pensioner but he was extra vulnerable.

      Our justice system is not serving its purpose. One of which is to remove the want for revenge.  Im sorry for the pensioner, but imagine that was your father or grandfather. I think there is a lot of people who would be biding their time for 4 years

      I am 100% convinced that judges give these kind of ridiculous sentences because they know that, the one judge that decides to be tough with scumbags is going to be harrased and threatened by them and their families, and neither the other judges nor the government are going to lift a finger to protect him.
      They know the system is broken so they are just biding their time until their pension without stepping on anyone’s toes. And the society is going to pay the price of this.

      He should have been jailed for life, 50+ years. You can’t just do something like that and get away it it (which is what 5 years is – practically getting away with it). Absolutely insane justice system in this country, it really beggars belief at times.
