  1. >Some critics of the case have drawn attention to Nicaragua’s own chequered human rights record, saying it is relevant to its decision to launching the case against Berlin.

    >Michaela Lissowsky, Head of the Human Rights Hub at the Friedrich Naumann Foundation, aligned with Germany’s Free Democratic Party, called the move “a cheap diversionary tactic”, pointing out that Nicaragua’s judiciary is under the control of the country’s president and vice president.

    >According to Lissowsky, Germany has been selected as the target of the case because Nicaragua is closely allied with Russia.

    >”Germany is not only supporting Ukraine in its defence against the Russian war of aggression, but is also defending itself against Russian disinformation and political influence,” she said.

“Serious systematic human rights violations, tantamount to crimes against humanity, continue to be perpetrated by the Nicaraguan government for political reasons. This is the conclusion of a recent report by the Group of Human Rights Experts on Nicaragua, chaired by Max Planck senior researcher Jan-Michael Simon.”

  3. >The decision, according to the judgment read in court in The Hague, is largely based on a significant decrease in recent German arms sales to [Israel](https://www.theguardian.com/world/israel), the largely defensive nature of arms recently sold, and the extensive internal German government processes to consider if arms would be used to prosecute war crimes or genocide.

AFAIK Germany isn’t even arguing that Israel isn’t committing war crimes. Just that the weapons delivered are not suitable to be used to in the war crimes. (The genocide allegations are another matter.)
